1. Parties, Definitions and Interpretation

In these Terms:

“Customer” means the individual or entity instructing HUBB Group LTD to carry out the Works.

“HUBB” means HUBB Group LTD.

“Contract” means the agreement between HUBB and the Customer, including these Terms.

“Works” means all services, labour, materials, investigations and associated activities carried out by HUBB.

“In writing” includes email and digital communication. Electronic signatures are valid.

2. General

2.1 These Terms apply to all Works and override any terms provided by the Customer unless agreed in writing.

2.2 The Contract constitutes the entire agreement between the parties.

2.3 No variation shall be valid unless agreed in writing.

2.4 HUBB may use subcontractors to carry out the Works. No contractual relationship shall arise between the Customer and any subcontractor.

3. Price, Estimates and Variations

3.1 Works are charged in accordance with HUBB’s standard rate card unless a written estimate has been accepted.

3.2 Estimates are valid for 28 days unless withdrawn earlier.

3.3 Accepted estimates are fixed price except where:

information provided is inaccurate or incomplete;

material or supply costs increase significantly;

additional or unforeseen works are required.

3.4 HUBB reserves the right to apply a mark-up of up to 65% on materials to cover sourcing, procurement and overhead.

3.5 Time is charged in minimum one-hour blocks, then in half-hour increments thereafter.

3.6 All prices are exclusive of VAT unless stated otherwise.

4. Nature of Works (IMPORTANT)

4.1 Leak detection and diagnostic works are investigative in nature.

4.2 HUBB will exercise reasonable skill and care; however, no guarantee is given that a leak or fault will be located.

4.3 All time spent, equipment used, and materials supplied during investigations are chargeable regardless of outcome.

4.4 Any parts replaced during diagnostics remain chargeable, even if later found not to be the root cause.

5. Payment Terms

5.1 Non-account Customers: Payment is due immediately upon completion of each day’s works.

5.2 Account Customers: Payment is due within 30 days of invoice date.

5.3 HUBB reserves the right to request deposits, staged payments, or daily payments for multi-day works.

5.4 HUBB may suspend or withdraw services immediately in the event of non-payment.

5.5 Interest will be charged on overdue invoices:

Consumers: 4% above Bank of England base rate

Commercial: pursuant to the Late Payment of Commercial Debts (Interest) Act

5.6 Reports, certificates, and documentation will not be released until full payment is received.

5.7 All time on site is chargeable, including investigation, waiting time, access delays, discussions, and reporting.

6. Insurance Work

6.1 HUBB may provide reports to assist with insurance claims.

6.2 HUBB gives no guarantee that any costs will be reimbursed by an insurer.

6.3 The Customer remains fully liable for all charges regardless of claim outcome.

7. Access and Responsibilities

7.1 The Customer must provide safe and unobstructed access.

7.2 The Customer must supply power and water where required.

7.3 The Customer is responsible for obtaining any necessary permissions.

7.4 The Customer must remove fixtures, fittings, and belongings prior to works.

7.5 The Customer is responsible for the safety of HUBB’s tools and equipment on site.

8. Invasive Works & Reinstatement

8.1 The Customer acknowledges that the Works may involve invasive procedures including lifting floors, breaking walls, and excavation.

8.2 HUBB will take reasonable care; however, HUBB is not responsible for reinstatement unless explicitly agreed in writing.

9. Waste Removal

Unless agreed otherwise, waste removal remains the responsibility of the Customer.

10. Timeframes

All dates and times are estimates only. HUBB shall not be liable for delays arising from site conditions, access issues, material delays, or events beyond its control.

11. Inspection and Complaints

11.1 The Customer must inspect the Works and notify HUBB of any issues within 7 days.

11.2 Where a defect is accepted, HUBB will rectify it within a reasonable time.

11.3 If third parties are instructed before HUBB is given the opportunity to rectify, HUBB shall not be liable for associated costs.

12. Warranty and Defects

12.1 HUBB will rectify defects arising from its workmanship within 12 months, subject to full payment and written notification.

12.2 Exclusions include pre-existing defects, third-party work, misuse, structural issues, and external causes.

12.3 Manufacturer warranties apply to supplied parts only.

13. Limitation of Liability

13.1 HUBB’s total liability shall not exceed the value of the Works paid or payable under the Contract.

13.2 HUBB shall not be liable for indirect or consequential losses, including loss of earnings, business, or profits.

13.3 Nothing in these Terms excludes liability for death or personal injury caused by negligence.

14. Customer Liability

14.1 The Customer shall be responsible for delays, damage to equipment, and any failure to meet their obligations.

14.2 The Customer shall indemnify HUBB against all resulting claims, losses, and expenses.

15. Cancellation

15.1 Cancellation less than 2 hours before attendance will incur a £50 + VAT charge or a minimum one-hour charge if the engineer has attended.

15.2 For works exceeding £1,000, a 14-day cooling-off period applies unless works have commenced.

15.3 Cancellation charges:

Less than 14 days: 5%

Less than 7 days: 10%

Less than 2 days: 20%

15.4 Any costs already incurred remain payable.

16. Force Majeure

HUBB shall not be liable for any delay or failure due to events beyond its reasonable control.
